Chhattisgarh High Court Rules on MACP Eligibility for Loco Pilots

In a significant ruling for railway personnel, the High Court of Chhattisgarh at Bilaspur has dismissed a petition by the Union of India, affirming the eligibility of Loco Pilots for the Modified Assured Career Progression (MACP) scheme. The judgment, delivered by a Division Bench comprising Justice Rajani Dubey and Justice Amitendra Kishore Prasad, clarifies that lateral shifts within the same grade pay do not constitute a "promotion" that would disqualify an employee from future financial up-gradations.

A Dispute Over Career Progression

The core of the dispute involved 10 Loco Pilots who argued they were entitled to the 3rd financial up-gradation under the MACP scheme. The Railway authorities contended that these employees had already received two promotions during their service—transitioning from Assistant Loco Pilot to Senior Assistant Loco Pilot, and subsequently to Loco Pilot (Goods), both within a Grade Pay of ₹4,200—thereby exhausting their MACP eligibility quota.

The Central Administrative Tribunal (CAT), Jabalpur, had initially ruled in favor of the Loco Pilots, ordering the Railways to grant the benefits within three months. Challenging this, the Union of India approached the High Court, asserting that the Tribunal ignored the framework of the MACP scheme, which requires every grade shift to be counted as a promotion.

Judicial Analysis: Promotion vs. Lateral Induction

The High Court’s analysis centered on the distinction between a true promotion and a lateral induction. Pointing to the High Court of Madhya Pradesh’s ruling in UOI v. K. Bhaskaran and the Allahabad High Court’s stance in UOI v. CAT and others , the Court emphasized that movement between posts carrying the same grade pay often functions merely as a "lateral induction" rather than a substantive promotion.

The Court noted that the appellants failed to adequately demonstrate that these transitions were true functional promotions as defined under their specific recruitment regulations. The judges held that a mechanical application of promotional ceilings would defeat the very purpose of the MACP scheme, which is intended to provide relief to employees facing stagnation.

Key Observations from the Bench

The Court relied on several foundational principles to ensure a harmonious interpretation of the scheme:

  • On the Nature of Promotions: The Court highlighted that, "Promotions earned in the post carrying same grade pay in the promotional hierarchy as per Recruitment Rules shall be counted for the purpose of MACPS," but clarified that these must be actual, not incidental, shifts.
  • On the Employer's Burden: Justice Dubey observed, "If it was a promotion, in what manner such consideration was done and whether that was granted to the persons like respondent in due course of employment... was required to be proved by the petitioners. Nothing in that respect has been produced before the Tribunal."
  • On Legislative Intent: The Court quoted the Ernakulam Bench of the CAT with approval, stating, "...the courts will, therefore, reject the construction which is likely to defeat the plain intention of the legislature even though there may be some inexactitude in the language used."

Final Ruling and Implications

The High Court dismissed the Union of India's petition, finding no illegality in the order of the Tribunal. By citing a recent dismissal of a Special Leave Petition (SLP) by the Supreme Court regarding similar claims in the Southern Railway, the Court signaled that this interpretation is gaining firm judicial consensus.

For Loco Pilots and many other railway categories, this decision reinforces the right to fair financial progression, preventing authorities from misclassifying lateral moves as promotions to deny long-overdue benefits. The ruling mandates immediate compliance, potentially setting a precedent for pending disputes regarding the MACP scheme across various railway zones in India.
