On February 19, 2025, the High Court of Kerala upheld the conviction of an individual charged with multiple counts of rape and offences under the Protection of Children from Sexual Offences (POCSO) Act. The appellant, who was found guilty by the Special Court for Trial of Offences under POCSO Act in Wayanad, was sentenced to life imprisonment and fines for his crimes against a 17-year-old victim, who was also his relative.
The case stemmed from allegations that the appellant, aged 29 at the time of the offences, had repeatedly raped the victim, who was the daughter of his wife’s younger sister. The prosecution presented evidence that the appellant had threatened the victim, inducing fear that her relationship with her boyfriend would be exposed, which led to multiple instances of sexual abuse. The victim ultimately became pregnant and gave birth to a child on February 13, 2016.
The prosecution argued that the victim's testimony, corroborated by medical evidence and DNA analysis, established the appellant's guilt beyond reasonable doubt. They highlighted the victim's fear and the psychological manipulation she endured, which prevented her from disclosing the abuse immediately. The court was presented with DNA evidence confirming the appellant as the biological father of the child.

The court noted, "If evidence of the prosecutrix inspires confidence, it must be relied upon without seeking corroboration of her statement in material particulars." This principle guided the court's decision to uphold the conviction, as they found the victim's account to be both compelling and supported by DNA evidence.
The High Court dismissed the appeal, confirming the lower court's findings and sentences. The court also directed the District Legal Services Authority to expedite the compensation process for the victim, amounting to ₹7 lakhs, to aid her recovery and future. This ruling reinforces the judiciary's commitment to protecting the rights of victims of sexual offences and ensuring justice is served.
This case serves as a critical reminder of the legal system's role in addressing sexual violence, particularly against minors, and the importance of supporting victims in their pursuit of justice.
