Anatomy of a False Case: How a Jammu Court Took Down a Fabricated Prosecution

In a scathing rebuke of investigative malpractice, the Fast Track Court in Jammu has acquitted Subash Chopra, who spent over 19 months in incarceration for a crime that, according to the court, "never took place." The judgment serves as a chilling reminder of the consequences when law enforcement agencies abandon their duty to impartiality.

A Family Dispute Disguised as Crime

The case originated from a complaint filed in May 2022, wherein the complainant alleged that her uncle, Subash Chopra, had raped her twice in the middle of the night. Despite her allegations, the prosecution’s narrative quickly unravelled under courtroom scrutiny. The court noted that the victim lived in a joint family household with parents and two other uncles—all of whom, miraculously, remained oblivious to any outcry during the alleged 45-minute incident.

The Investigating Agency Under Fire

The presiding judge, Amarjeet Singh Langeh, did not mince words regarding the police conduct. The court characterized the investigation as "botched, fabricated, and concocted." Central to the court's concern was the undue influence exerted by outside entities—specifically two NGO workers—who appeared to dictate the course of the investigation, leading the police to ignore fundamental evidence gathering, such as securing the crime scene, collecting forensic evidence, or even analyzing CCTV footage properly.

Key Observations

The court's judgment highlights several systemic failures:

  • "Not only prosecution story in wholesome but also the testimony of PW victim, if I may say so - is patently absurd and palpably improbable."
  • "In the case in hand, Investigating Officer and his immediate Supervisory Officer (the then SHO) seem to have bent to the will of... NGO [workers]... in initiating the FIR in question and in conducting subsequent investigation."
  • "It is because of tainted and fabricated investigation that accused seems to have faced trauma of being framed up in an occurrence which never took place."
  • "Fair investigation is an essential part of fair trial."

Accountability and Restitution

The court’s decision extends far beyond the mere acquittal of the accused. Recognizing that the system had failed, Justice Langeh issued firm directives to hold the errant officials accountable.

The Inspector General of Police, Jammu, has been ordered to initiate departmental inquiries against the Investigating Officer and the then-SHO of Police Station R.S. Pura. Furthermore, the Senior Superintendent of Police (SSP) Jammu is tasked with investigating the roles of the NGO workers involved in the allegedly false registration of the FIR and has been directed to initiate independent action against the complainant under Section 182 of the RPC for providing false information.

This judgment serves as a powerful judicial intervention against the misuse of legal processes, ensuring that the heavy mantle of criminal law is not used as a tool for personal vendettas or family property disputes.
