These included the unequal distribution of the property, the exclusion of the majority of the children without any explanation, and the allocation of the property to the defendants through multiple schedules, despite the entire land being a single compact plot.
The court noted that while the testator's right to distribute his property unequally is generally accepted, the circumstances in this case raised legitimate doubts about the genuineness of the will. The court emphasized that the burden was on the will's proponents to remove all such suspicious circumstances, which they had failed to do.
