judgement
Subject : - Externment Order
The petitioner, a 33-year-old man, challenged an externment order issued by the authorities that restricted him from entering the Kannur Revenue District for a period of six months. The petitioner was involved in three criminal cases, two of which were minor offenses.
The petitioner argued that he was the sole breadwinner of his family, which includes his wife, children, and parents. He had already suffered an externment order for two months and claimed that the current order would severely impact his ability to support his family.
The court considered the fact that the petitioner was the sole breadwinner of his family and had already endured an externment order for two months. Recognizing the hardship this would cause, the court decided to limit the operation of the externment order to the date of the judgment (June 10, 2024).
The court further ordered the petitioner to appear before the Station House Officer, Panoor Police Station, every Sunday at 11 am for a period of three months. This condition was imposed to ensure the petitioner's compliance with the law and to allow the authorities to monitor his activities.
The court disposed of the writ petition, limiting the externment order to the date of the judgment and imposing the condition of periodic reporting to the police station. The court emphasized that any violation of the condition would allow the respondent to proceed against the petitioner in accordance with the law.
