judgement
Subject : - Externment Orders
The petitioner, a 25-year-old individual, has challenged an externment order issued against them by the authorities. The externment order, originally issued for a period of six months, had restricted the petitioner from entering the Kannur Revenue District.
The petitioner argued that the externment order was unjustified, given their young age and the nature of the alleged offenses. The respondents, on the other hand, maintained that the externment order was necessary to maintain public order and prevent the petitioner from engaging in further criminal activities.
The court, after considering the facts of the case, decided to limit the operation of the externment order to the date of the judgment (10.06.2024). The court noted that the petitioner's young age and the nature of the alleged offenses warranted a more lenient approach.
Instead of the externment order, the court directed the petitioner to report to the Station House Officer, Cherupuzha Police Station, every Sunday at 11 am for a period of two months. The court emphasized that any violation of this condition would allow the respondents to initiate further action against the petitioner in accordance with the law.
The court disposed of the writ petition, effectively limiting the externment order and allowing the petitioner to report to the police station on a weekly basis for a specified duration. This decision strikes a balance between the concerns of public order and the petitioner's rights, providing a more tailored approach to the case.
