Subject: - Land Use and Conservation
In a recent court judgment, the petitioner, who claims to be the owner of a property in Thazhekad Village, Kallettumkara Sub Registry, has been granted relief in their application for a change of land use under the Kerala Conservation of Paddy Land and Wetland Act and Rules, 2008.
The petitioner had filed an application under Form-7 of the Act and Rules, seeking a change in the nature of the property in the data bank. The petitioner's counsel argued that no orders had been passed on the statutory application so far.
The court has directed the additional fifth respondent Village Officer to provide sufficient inputs required under the Act and Rules to the third respondent Revenue Divisional Officer within two months. Upon receiving the inputs, the Revenue Divisional Officer is required to consider the petitioner's application within the next two months and pass orders strictly in accordance with the Act and Rules.
The court has disposed of the writ petition, granting the petitioner's request for a direction to the authorities to consider the application for a change of land use in a timely manner and in compliance with the relevant laws.
