In a recent court judgment, the petitioner, who claims to be the owner of a 10-acre property in Amarambalam Village, Malappuram District, Kerala, has been granted relief in their application for a change of land use under the Kerala Conservation of Paddy Land and Wetland Act and Rules, 2008.
The petitioner had filed an application under Form-6 of the Kerala Conservation of Paddy Land and Wetland Act and Rules, 2008, seeking a change in the user of the nature of their property. However, the petitioner stated that no orders had been passed on the statutory application so far.
The court has directed the second respondent, the Village Officer, to provide the necessary inputs required under the Act and the Rules to the first respondent, the Revenue Divisional Officer, within one month from the date of the judgment. Upon receiving the inputs, the Revenue Divisional Officer is required to consider the petitioner's application within two months and pass orders strictly in accordance with the Act and the Rules.
The court has disposed of the writ petition, granting the petitioner's request for a direction to the authorities to consider their application for a change of land use in a timely manner. This decision ensures that the petitioner's application will be reviewed and decided upon in accordance with the relevant laws and regulations governing land use changes in Kerala.
