# Court Overturns Murder Convictions, Reduces Sentences in Football Tournament Tragedy
A tragic incident occurred at the venue of a football tournament, resulting in the death of a spectator. The semi-final of the tournament took place on February 3, 2008, and the team "Pulath Track Force" won the match. However, a petty fight broke out between the team members and supporters and the tournament organizers after the game. The final match took place on February 8, 2008, and the team lost. Immediately after the final, a group of the team's supporters and spectators were involved in a clash with the organizers, leading to the death of one spectator,
The prosecution argued that the accused, who were among the tournament organizers, had hatched a criminal conspiracy to commit the murder of
The court found that the prosecution failed to establish the offence of criminal conspiracy, as the evidence did not show a prior meeting of minds and a consequent agreement among the accused to commit the offenses. The court also held that while the accused formed an unlawful assembly, their common object was not to commit murder or cause grievous hurt, but rather to beat the team's members and supporters. The court concluded that only the first three accused, who chased the deceased and inflicted blows on his head using wooden reapers, were liable for culpable homicide not amounting to murder under Section 304 of the Indian Penal Code .
The court overturned the murder convictions of the accused, except for the first three accused, and reduced their sentences. The convictions of the remaining accused under Sections 143, 147, 148, and 324 read with Section 149 of the Indian Penal Code were upheld. The court also held that the imprisonment already undergone by the accused was sufficient for the offenses they were found guilty of.
This judgment highlights the importance of carefully analyzing the evidence and the specific actions of each accused in cases involving unlawful assemblies and common objects, to ensure that the appropriate charges and sentences are applied.
