The municipal commissioner, in his defense, claimed that he had passed appropriate orders within the stipulated time frame, directing the petitioner to approach the Commissioner & Director of Municipal Administration for further action. The commissioner argued that he had not intentionally or deliberately violated the court's directions.
The High Court, in its detailed judgment, found the municipal commissioner's actions to be a clear violation of the court's orders. The court noted that the commissioner had not only disobeyed the court's directive but had also failed to implement the orders of the higher authority, the Commissioner & Director of Municipal Administration.
The court emphasized that once a court issues an order, it must be complied with without any reservation. The court held that the commissioner's attempt to interpret the order and give it a different meaning was illegal and amounted to a conscious violation of the rule of law.
The High Court found the municipal commissioner guilty of contempt of court and sentenced him to six months of simple imprisonment and a fine of ₹2,000. The court, however, suspended the order for four weeks to allow the commissioner to appeal the decision.
This judgment serves as a strong message that the courts will not tolerate willful disobedience of their orders, even by government officials. It underscores the importance of the rule of law and the need for strict compliance with court directives to maintain the integrity of the judicial system.
