judgement
Subject : Civil Law - Motor Vehicle Accident Claims
In a motor accident case, the claimant/injured,
The appellant/insurance company, New India Assurance Company Ltd., challenged the compensation awarded to the claimant, arguing that the amount was excessive and arbitrary. The insurance company also claimed that it should not be liable to pay the compensation as the offending bus was being driven without a valid permit to ply in the Delhi jurisdiction.
The court carefully examined the evidence, including the medical records and testimony of the treating doctor, and found that the claimant had indeed suffered severe injuries that would require extensive future treatment. The court held that the compensation awarded by the lower tribunal was fair and reasonable, and did not interfere with the quantum.
Regarding the insurance company's argument about the lack of a valid permit, the court relied on previous judgments that had established that such permit violations are not sufficient to exonerate the insurance company from liability. The court found that the insurance company failed to prove a fundamental breach of the policy terms by the insured.
The court dismissed the appeal filed by the insurance company and upheld the compensation awarded to the claimant/injured. The insurance company was directed to release the compensation amount, along with enhanced interest, within four weeks.
This judgment reinforces the principle that insurance companies cannot easily avoid liability for motor accident claims based on technicalities, such as permit violations, if the accident and injuries are otherwise established. The court's emphasis on the need for insurance companies to prove a fundamental breach of policy terms to avoid liability is a significant outcome of this case.
