Courtroom Attack in Gujarat Ignites Urgent Call for Judicial Security

Ahmedabad, Gujarat – The sanctity of the courtroom was breached for the second time in just over a week when a disgruntled litigant hurled his shoes at an Additional Principal Judge in Ahmedabad's City Civil and Sessions Court. The incident, occurring on the heels of a similar attack on Chief Justice of India (CJI) B.R. Gavai, has sent shockwaves through the legal fraternity, triggering an urgent and forceful demand from the Gujarat Judicial Service Association (GJSA) for enhanced security measures to protect the judiciary.

The dramatic event unfolded on Tuesday inside the courtroom of Additional Principal Judge M.P. Purohit at the Bhadra court complex. An appellant, reportedly infuriated by the court's decision to uphold the acquittal of four individuals in a 28-year-old assault case, erupted in the middle of proceedings. After shouting abuses, he removed his shoes and threw them towards the judge's dais. While Judge Purohit was unharmed, the act itself represents a grave assault on the dignity and authority of the court.

In a remarkable display of judicial temperament, Judge Purohit instructed court staff and police not to take any formal action against the man, who was promptly detained but later released at the judge's request. This act of restraint stands in stark contrast to the severity of the offense, highlighting a complex dilemma for judicial officers facing direct and personal attacks.

This incident is not an isolated one. It follows the October 6th event where a 71-year-old advocate threw a shoe at CJI Gavai during a Supreme Court hearing, an act that led to the immediate suspension of his license by the Bar Council of India. The proximity of these two events has moved the conversation from isolated outbursts to a systemic concern about the safety and security of judicial officers across the country.

A Decades-Old Case and a Moment of Contempt

The catalyst for the outburst in Judge Purohit's courtroom was a case with roots stretching back to 1997. The man who threw the shoes was the complainant in an assault case where his father was allegedly attacked following a minor altercation involving a cricket ball in the Gomtipur area. Four men were charged, but a metropolitan court acquitted them in 2017 after years of proceedings.

The complainant appealed this decision to the Sessions Court. On Monday, October 13, 2025, after reviewing the case, the Sessions Court upheld the lower court's acquittal and dismissed the appeal. The following day, the man returned to the courtroom, and his simmering frustration boiled over into an act of profound contempt. Public Prosecutor Sudhir Brahmbhatt confirmed that lawyers and police personnel attempted to de-escalate the situation, but the man's agitation intensified, culminating in the attack.

The Judiciary's Response: A Demand for Action and Solidarity

The response from the judiciary was swift and unequivocal. The Gujarat Judicial Service Association (GJSA), Ahmedabad, issued a strongly worded resolution on October 14, 2025, condemning the attacks on both the Ahmedabad court and the Supreme Court. The resolution, signed by President S.G. Dodiya and Vice-President P.I. Prajapati, frames the incidents as a foundational threat to the justice system.

"The Gujarat Judicial Service Association, Ahmedabad unequivocally condemns the reported attack / threat / vandalism against the Hon'ble Supreme Court & Hon'ble City Civil Court, Ahmedabad. Such acts constitute a direct assault on the independence, dignity, security and functioning of the judiciary," the resolution stated.

The GJSA emphasized the broader constitutional implications, arguing that such acts undermine the very fabric of democratic governance. The resolution further noted that "the rule of law, public confidence in the judicial system, and constitutional governance demand that courts operate free from fear, intimidation or violence."

Moving beyond condemnation, the Association issued a clear call to action, urging "all relevant authorities — the State Government, Home Department, Police, and Security Agencies — to ensure immediate and stringent security measures to protect judicial officers, court staff, and court buildings." It also demanded that perpetrators be swiftly prosecuted under applicable laws to create a strong deterrent.

The GJSA also expressed solidarity with all members of the legal profession affected by these threats and reaffirmed its commitment to upholding institutional respect and the rule of law.

Legal and Systemic Implications: Contempt, Security, and Judicial Restraint

The incident in Ahmedabad raises critical legal and administrative questions that resonate with legal professionals nationwide.

1. The Nature of Contempt: The act of throwing a shoe at a presiding judge is a clear instance of criminal contempt in facie curiae (in the face of the court). It is a direct challenge to the court's authority and an obstruction of the administration of justice. While Judge Purohit’s decision not to initiate contempt proceedings or file a complaint demonstrates commendable restraint, it also sparks a debate on whether such leniency, in the face of a violent act, could inadvertently embolden future offenders. The primary purpose of contempt law is not to protect the individual judge but to safeguard the institution's ability to dispense justice impartially and without fear.

2. The Urgent Need for a Security Overhaul: These back-to-back incidents expose significant vulnerabilities in courtroom security protocols. While high-profile courts may have robust security, the incident in a busy sessions court highlights the risks faced by judicial officers at all levels of the hierarchy. The GJSA's call for "stringent security measures" will likely translate into demands for increased police presence, baggage screening at court entrances, and potentially dedicated protection for judges. This, however, must be balanced against the principle of open justice and ensuring that courts do not become inaccessible fortresses.

3. The Psychological Impact on the Judiciary: Beyond the physical threat, such attacks inflict a significant psychological toll on judges. The expectation that they remain impartial and dispassionate arbiters of volatile disputes becomes immensely more challenging when their personal safety is at risk. An environment of fear can lead to a chilling effect, subtly influencing judicial decision-making and undermining the courage required to deliver unpopular but legally sound judgments.

4. The Role of the Bar: The legal community has a vital role to play in upholding the dignity of the court. While the perpetrator in Ahmedabad was a litigant, the incident at the Supreme Court involved a lawyer. The Bar Council's swift action in that case was crucial. Bar associations across the country are now under pressure to reinforce ethical standards and actively condemn any behavior from litigants or their own members that disrespects judicial institutions.

As the legal community grapples with the fallout from these attacks, the central challenge will be to implement effective security reforms that protect judicial officers without compromising the fundamental principles of an accessible and open justice system. The incidents in Delhi and Ahmedabad serve as a stark warning that the dignity of the judiciary is not an abstract concept but a fragile pillar of democracy that requires constant and vigilant protection.
