Leave granted.
This appeal is at the instance of an accused apprehending arrest in connection with the Garhwa Police Station Case No.321 of 2020 registered for the offence punishable under Sections 467, 468,471,420, 385, 506 read with 34 of the Indian Penal Code (IPC).
The appellant has been arrayed as one of the accused in the alleged crime in his capacity as the Branch Manager of the Central Bank of India, Hazipur Branch, Bihar.
The High Court declined to grant Anticipatory Bail to the appellant for the reasons recorded in the impugned order.
We have heard the learned counsel appearing for the appellant- accused as well as the learned counsel appearing for the first informant and the learned counsel for the State.
Without expressing any opinion on the merits of the case, we are of the view that the appellant should appear before the Investigating Officer within a period of one week from today for the purpose of his interrogation.
The Investigating Officer shall collect the specimen signatures/hand writings of the appellant so as to forward the same to the handwriting expert alongwith the disputed signatures/hand writings for his opinion.
Subject to the condition of appearing before the Investigating Officer for the purpose of interrogation, the appellant, in the event of his arrest, shall be released on Anticipatory Bail, subject to terms and conditions that the Investigating Officer may deem fit and proper.
With the aforesaid observations, the appeal stands disposed of.
