In a decisive move to protect the rights and safety of an Indian citizen abroad, the High Court of Delhi has directed the Ministry of External Affairs (MEA) and the Consulate General of India in Dubai to take immediate action regarding a distressed Indian woman allegedly held captive in the United Arab Emirates.
The case centers on a 25-year-old nurse who, while working at a hospital in Chennai, became acquainted with a foreign national undergoing treatment. Persuaded by the prospect of better remuneration, she accepted a one-year medical assistance role under the individual in Dubai, arriving there on January 23, 2023.
What was intended to be a short-term professional opportunity turned into a harrowing ordeal. The petitioner, the woman’s father, submitted that communication with his daughter gradually declined over two years. The foreign national allegedly seized her passport and visa to prevent her departure. The situation escalated in October 2025, when the young woman reached out to her family with graphic reports of physical abuse, deprivation of basic necessities, and entrapment.
Following the failure of his initial representation to the Ministry of External Affairs on November 15, 2025, the petitioner approached the High Court of Delhi seeking a writ of mandamus, compelling the government to intervene and coordinate his daughter's rescue and eventual repatriation to India.
Recognizing the urgency and the potential threat to the individual's life and liberty, Hon'ble Mr. Justice Sachin Datta underscored the state's responsibility. The Court observed:
> "In the circumstances, given the gravity of the situation, the Ministry of External Affairs, Government of India and the Consulate General of India in Dubai, UAE are directed to take immediate steps to ensure the safety and well-being of the petitioner’s daughter and verify the allegations made in the present petition."
Furthermore, acknowledging the daughter's desire to return to her homeland, the Court ordered:
> "Further, assistance be rendered to the petitioner’s daughter for her return to India, if she so desires."
The High Court has set a strict timeline for the government, mandating that a status report regarding the efforts undertaken and the daughter's current situation be filed within two weeks. The matter is currently listed for further proceedings on December 15, 2025.
This order serves as a critical affirmation of the government’s obligation to provide consular protection to Indian citizens in distress abroad. By stepping in, the Court has not only highlighted the legal avenues available to families in such desperate circumstances but has also accelerated the bureaucratic response necessary to address allegations of human rights violations occurring outside Indian borders. The outcome of the upcoming status report will be closely monitored, as it carries profound implications for the safety of Indian nationals in similar vulnerable positions globally.
