In a significant move to curb digital piracy during high-stakes sporting events, the High Court of Delhi has expanded its legal armory. Justice Saurabh Banerjee recently ruled that the scope of "dynamic injunctions"—previously limited to websites—must now extend to rogue mobile applications that flagrantly violate copyright and broadcast reproduction rights.
The dispute centers on Star India Pvt Ltd, which holds exclusive rights to high-value sporting properties, including the Indian Premier League (IPL) 2025 and the upcoming England Tour of India. Faced with the proliferation of infringing platforms, the plaintiff sought relief against a growing list of "rogue" entities that mirror or redirect content to illegal streaming interfaces.
The plaintiff argued that procedural delays—the time it takes to petition the court for each new mirror site or application—effectively render their legal rights "otiose" in the fast-paced world of live sports broadcasting. With vacation periods looming, the need for a proactive, real-time mechanism was presented as a matter of commercial urgency.
Recognizing the rapid evolution of technology, the Court observed that infringers thrive on "alpha-numeric/mirror/redirect variants." Justice Banerjee coined the term "superlative injunction" to describe an extension of the existing dynamic+ injunction regime.
The Court clarified that the medium of transmission is secondary to the harm being caused. Whether it is a website or a mobile application, if the platform’s predominant intent is to bypass intellectual property protections for unauthorized streaming, it falls squarely within the reach of the Court’s equitable jurisdiction.
The ruling emphasizes that the Court must adapt to the "new age of technology" to protect copyright holders:
The Court drew support from its previous decision in Star India Private Limited v. https//crichdplayer.org & Ors. and Star India Pvt. Ltd. & Anr. v. Jiolive.Tv and Ors. , which established the necessity of real-time blocking for sporting events.
By this order, the Court has directed domain name registrars to suspend infringing domains and tasked ISPs with blocking access on a real-time basis. Crucially, this relief is effective until July 3, 2025, covering the peak of the upcoming England Tour of India.
The decision marks a critical milestone for rightsholders, signaling that the Indian judiciary is prepared to evolve its injunctive powers to match the speed of digital piracy. For platforms and developers engaged in the unauthorized broadcast of content, the mandate is clear: the law is no longer confined to the desktop, and the "real-time" reach of the court is expanding to every corner of the digital ecosystem.
