Curbing the Hydra: Delhi HC Issues ‘Dynamic+’ Injunction to Protect India Tour of England 2025

The digital landscape has become a challenging frontier for sports broadcasters, where live content can be pilfered and redistributed within seconds. In a significant move to protect intellectual property rights, the Delhi High Court has granted an ex parte ad interim ‘dynamic+’ injunction in favor of JioStar India Pvt. Ltd. (formerly Star India), shielding its exclusive media rights for the upcoming India Tour of England 2025 (ITE 2025).

The Case: A Battle Against 'Rogue' Platforms

JioStar, as the holder of exclusive digital media rights for the ITE 2025, approached the court apprehending massive copyright infringement. The plaintiff argued that "rogue websites" have developed a sophisticated, "hydra-headed" business model: they set up, stream, and then quickly deactivate websites or mirror domains almost instantaneously when a live sporting event unfolds.

Citing the precedent set during the IPL 2025, the plaintiff sought proactive Judicial intervention to block these platforms before they could siphon off their viewership during the upcoming test series scheduled between June and August 2025.

Legal Reasoning: Beyond Traditional Barriers

Justice Saurabh Banerjee, presiding over the matter, underscored the need for judicial agility. Recognizing that traditional injunctions are often too slow for the fast-paced nature of live broadcasting, the Court adopted a ‘dynamic+’ approach—a specialized relief designed to address the evolving technological nature of online piracy.

The Court observed that: > "This so-called dangerous edge has become even sharper with the fast-paced evolution of certain 'hydra-headed' websites, which, even if blocked/ deleted, have the incredulous potential to resurface in multitudes as alphanumeric or mirror websites."

By granting this injunction, the Court empowered the plaintiff to provide details of emerging mirror sites directly to Domain Name Registrars (DNRs) and Internet Service Providers (ISPs) for real-time blocking, without needing to return to the court for a fresh order for every new link found.

The Court emphasized that intellectual property rights must remain enforceable even in the face of technological subterfuge. Notable excerpts from the judgment include:

  • On the necessity of effective relief: "The rights of a plaintiff, who is an intellectual property right holder, cannot be rendered otiose in this world of rapidly developing technology."
  • On the nature of infringing platforms: "The present case appears, prima facie, to be a clear example of copyright infringement by entities... who are using modern technology to hide their identities while unlawfully benefiting from the plaintiff’s copyrighted works."
  • On the 'Dynamic+' mechanism: "‘Dynamic+’ injunction is granted in favour of the plaintiff to protect its copyrighted works as soon as they are infringed/ created."

Implications for the Future

The decision serves as a stern warning to digital platforms engaged in the unauthorized transmission of copyrighted content. By directing the Department of Telecommunications (DoT) and the Ministry of Electronics and Information Technology (MEITY) to ensure compliance by ISPs, the Court has created a robust framework for real-time protection.

For right-holders, this ruling reaffirms a strong judicial backing to combat the 'dangerous edge' of technology, ensuring that exclusive broadcast rights remain a protected asset rather than a target for anonymous, transient digital entities. The suit is next listed for hearing on October 13, 2025, by which time the effectiveness of the current mechanism will likely provide further guidance for future jurisprudence.
