Delhi High Court Shields BharatPe Brand in Major Trademark Ruling

In a significant move to protect intellectual property in the booming fintech sector, the High Court of Delhi has issued a sweeping interim injunction against entities operating under the name "Bharatpay." The order, delivered by Hon'ble Mr. Justice Amit Bansal, marks a decisive victory for Resilient Innovations Private Limited—the parent company behind the popular payment services brand, BharatPe.

The Backdrop of the Dispute

Since its incorporation in 2018, Resilient Innovations has carved a massive footprint in the Indian digital payments landscape, boasting over 2.52 million active merchants across the country. The company provides a suite of utility tools, including universal QR codes and payment reconciliation services, primarily through its web domains and mobile applications under the "BharatPe" trade name.

The dispute arose in January 2025 when the Plaintiff discovered that "Bharatpay" had launched an identical suite of financial services, including bill payments and data recharges. Despite issuing a cease-and-desist notice, the Defendants remained non-responsive, prompting a legal challenge in the Delhi High Court.

A Clear Case of Copycat Branding

The legal battle centered on whether the use of the name and logo "Bharatpay" amounted to an attempt to mislead the public. The court’s analysis was swift and critical, drawing a direct parallel between the brand identities.

"The impugned marks adopted by the defendant no.1 is phonetically identical with, and visually, structurally and conceptually similar to, the BharatPe marks of the plaintiff," the Court noted. Justice Bansal further highlighted that the Defendants' business location, as listed on their website, pointed toward a street vendor’s location, raising concerns about the legitimacy of the operation.

Key Observations from the Bench

The Court emphasized that failing to intervene would cause irreversible damage to the Plaintiff’s brand reputation and place innocent consumers at risk of financial fraud:

  • "A prima facie case of infringement of trade marks and passing off is made out on behalf of the plaintiff in its favour."
  • "Irreparable loss, harm and injury would be caused to the plaintiff if the defendant no.1 continues to use and operate under the impugned domain name and mobile application."
  • "Prejudice would also be caused to the public as the use of the impugned domain name and mobile application by the defendant no.1 would result in misleading and defrauding innocent members of the public."

Immediate Legal Consequences

The High Court’s order acts as an immediate shield for the Plaintiff. The Defendants have been restrained from using, advertising, or creating marketing material under the "Bharatpay" or any deceptively similar marks.

Furthermore, the Court issued specific directives to curb the reach of the impugned services: 1. Domain Suspension: Defendant no.2 is ordered to suspend the domain 'www.bharatpay.net'. 2. Telecommunications Crackdown: Defendant no.3 is ordered to block the mobile number allegedly used by the Defendants. 3. ISP Intervention: Relevant authorities are directed to notify Internet Service Providers (ISPs) to block access to the domain in question.

This ruling underscores the judiciary’s commitment to maintaining brand integrity in India's digital economy, ensuring that users can distinguish between established service providers and fraudulent imitators. The case is set for the next hearing before the Joint Registrar on May 9, 2025, for the completion of pleadings.
