In a recent ruling, the High Court of Delhi has reinforced a fundamental principle of insurance law: the sanctity of policy commencement dates. The Division Bench, comprising Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela, dismissed an appeal by Darshana Rani, whose son—a practicing advocate—passed away mere months before his enrolled Group (Term) Insurance policy under the Chief Minister Advocates Welfare Scheme (CMAWS) took effect.
The case involved late Sh. Kamal Khurana, who had registered for the CMAWS in 2019. Due to delays in verifying his Electoral Photo Identification Card (EPIC) and enrolment credentials, he was not included in the scheme's previous cycles. However, following a re-application and successful verification process, his inclusion was confirmed for the policy period spanning October 20, 2023, to October 19, 2024.
The core of the dispute lay in a tragic timeline: Sh. Khurana passed away on August 2, 2023—seventy-nine days before his insurance coverage was set to commence. When his mother sought the INR 10 Lakh life insurance claim, the government rejected it, citing that no contractual obligation existed at the time of death.
The appellant contended that the registration process and the subsequent inclusion should warrant a sympathetic interpretation. The respondents, however, maintained that the scheme is strictly governed by the insurance contract period.
The Court was presented with the question: Does registration for a welfare scheme confer rights before the underwriting authority officially activates the policy? The Court’s answer was a clear, albeit empathetic, "no."
The High Court’s ruling underscored that legal entitlement is tethered to the specific terms of the insurance contract, regardless of the hardship faced by the beneficiaries:
While the court upheld the denial of the claim on strict legal grounds, it adopted a proactive stance regarding the welfare of the bereaved family. Upon intervention by the Bench, it was revealed that the Bar Council of Delhi (BCD) had already stepped in to provide financial assistance of INR 10,000 per month for two years through its "Indigent & Disabled Lawyers Committee."
The Court did not stop there. It issued a strong recommendation for the Bar Council of India and BCD to craft comprehensive social security policies, recognizing that the families of advocates often lack a safety net when the primary breadwinner passes away unexpectedly.
This decision acts as a sober reminder for professionals navigating government-sponsored welfare schemes: "registration" and "active coverage" are not synonymous. For legal professionals and their families, the judgment advocates for a proactive approach in verifying policy activation dates, while simultaneously signaling to regulatory bodies that the current social welfare framework for advocates remains in dire need of expansion.
The appellant has been granted the liberty to approach the Bar Council of India and other relevant authorities to seek further assistance, with the Court requesting that these bodies treat her application with the "sympathetic" consideration the circumstances demand.
