Delhi HC Invokes INTERPOL Red Corner Notice for Contempt: Maintenance Orders Under Contempt of Courts Act

In a stern message to litigants attempting to evade judicial mandates, the Delhi High Court has sentenced a UK-based respondent to six months simple imprisonment for flagrant and wilful disobedience of court-ordered maintenance. Justice Sachin Datta, presiding over the matter, further ordered the Central Bureau of Investigation (CBI) to initiate the process for an INTERPOL Red Corner Notice to ensure the respondent is apprehended upon entering India.

A History of Evasion The conflict originated from a Guardianship petition initiated by the petitioner in 2022 regarding the maintenance of their minor daughter. Despite clear directives from both the Family Court and a Division Bench of the Delhi High Court to pay Rs 1.40 lakhs per month, the respondent persistently failed to comply.

The court noted that the respondent, a former MBA and coach residing in the UK, engaged in a series of calculated maneuvers to shrink his disclosed assets. These included triggering voluntary liquidation of his companies— GSM Traders Limited and GSM Traders Property Company Limited —specifically after legal disputes surfaced in India, and suppressing details of cryptocurrency investments and multiple offshore bank accounts.

The Court’s Firm Stand The respondent’s conduct escalated into open defiance when he sent an email declaring his withdrawal from the jurisdiction of Indian courts. Justice Datta observed that such an assertion was an " affront to the Court and its majesty," and characterized the respondent's actions as a " mockery of the judicial process ."

In his ruling, Justice Datta emphasized that adherence to judicial orders is a cornerstone of the rule of law . "The faith posed by the people in the judiciary has to be protected in the interest of society, and also to meet the ends of justice ," the court remarked, drawing on precedents such as Sonali Bhatia v. Abhivansh Narang and Ashok Paper Kamgar Union v. Dharam Godha .
