Delhi High Court Orders Immediate Disbursement of Relief to North-East Delhi Riot Victims

In a significant move to address the lingering grievance of riot victims, the High Court of Delhi has directed the Government of National Capital Territory of Delhi (GNCTD) to release compensation amounts recommended by the North East Riot Delhi Commission. The order, passed by Hon'ble Mr. Justice Sachin Datta, concerns a batch of five writ petitions filed by individuals seeking relief for losses suffered during the 2020 North East Delhi riots.

The Path to Relief

The petitioning parties, including Mumtiyaj Ali, Mohd Gul Hasan, Mohd Nasim, Faheem Akhtar, and Khalil Ahmad, had collectively challenged the state’s delay in processing compensation claims. While the petitioners argued that the amounts assessed by the Commission were merely a fraction of their actual, entitled claims, they sought the court's intervention to secure at least the recommended funds as an interim measure.

During the hearing, legal counsel representing the respondents did not oppose the request for the release of these specific, commission-recommended amounts, paving the way for the court’s swift intervention.

Judicial Mandate

Justice Sachin Datta underscored that the financial hardship faced by the petitioners necessitated expeditious action. The Court directed the GNCTD to ensure the distribution of the assessed amounts within a period of eight weeks. Crucially, the court specified that this disbursement is "without prejudice to the rights and contentions" of the petitioners, allowing them to pursue higher compensation or additional relief in future proceedings despite accepting the initial recommended sum.

Key Observations

The Court’s order highlights the necessity of administrative accountability in relief matters:

  • On the status of recommendations: "Learned counsel for the petitioners submits that the North East Riot Delhi Commission has rendered findings and made recommendations qua the claims in respect of 14 out of present batch of 19 petitions."
  • On the urgency of disbursement: "Accordingly, the respondent no.2 is directed to release the amount recommended by the North East Riot Delhi Commission qua the petitioners in the present batch of cases."
  • On the timeline: "Let the requisite amount be released within a period of eight weeks from today."

Implications for Future Claims

This directive serves as a reminder of the role of judicial oversight in administrative compensation schemes. By mandating a strict timeframe for the release of funds, the Delhi High Court has provided a procedural safeguard for victim relief. While this order resolves the immediate demand for the base-level compensation recommended by the commission, it leaves the door open for petitioners to argue for more substantial damages, ensuring that the acceptance of this partial relief does not extinguish their wider legal claims.

The decision is expected to bring immediate financial relief to the affected families while highlighting the ongoing efforts to address individual claims arising from the communal unrest in North-East Delhi.
