The order, passed by Hon'ble Mr. Justice Sachin Datta, concerns a batch of five writ petitions filed by individuals seeking relief for losses suffered during the 2020 North East Delhi riots.
The petitioning parties, including Mumtiyaj Ali, Mohd Gul Hasan, Mohd Nasim, Faheem Akhtar, and Khalil Ahmad, had collectively challenged the state’s delay in processing compensation claims. While the petitioners argued that the amounts assessed by the Commission were merely a fraction of their actual, entitled claims, they sought the court's intervention to secure at least the recommended funds as an interim measure.
During the hearing, legal counsel representing the respondents did not oppose the request for the release of these specific, commission-recommended amounts, paving the way for the court’s swift intervention.
Justice Sachin Datta underscored that the financial hardship faced by the petitioners necessitated expeditious action. The Court directed the GNCTD to ensure the distribution of the assessed amounts within a period of eight weeks. Crucially, the court specified that this disbursement is "without prejudice to the rights and contentions" of the petitioners, allowing them to pursue higher compensation or additional relief in future proceedings despite accepting the initial recommended sum.
