The order, passed by Justice Sachin Datta on January 15, 2025, effectively addresses a batch of 19 petitions filed by individuals seeking financial assistance.
Nearly five years after the communal violence that rocked North East Delhi, the struggle for financial restitution continues for many affected residents. The current batch of petitions—including cases filed by individuals like Mumtiyaj Ali, Mohd Gul Hasan, Mohd Nasim, Faheem Akhtar, and Khalil Ahmad—highlights the procedural delays hindering the disbursement of relief funds.
The core legal question before the court was whether the government could be compelled to release funds assessed and recommended by the investigative commission, despite ongoing claims for higher, more comprehensive compensation.
During the proceedings, counsel for the petitioners acknowledged that the compensation amounts recommended by the North East Riot Delhi Commission represent only a "fraction" of what the riot victims feel they are entitled to receive. However, faced with a long wait and pressing economic hardship, the petitioners requested that the court direct the GNCTD to release the recommended amounts as an immediate measure.
In a constructive stance, the counsel representing the GNCTD (Respondent No. 2) did not oppose the request for the release of these specific funds, leading to a swift judicial intervention.
The court’s decision was underlined by a focus on practical, immediate relief. Justice Sachin Datta summarized the urgency and the nature of the order as follows:
The court’s decision is a critical procedural victory for the victims, ensuring that a basic level of financial assistance is secured while their broader claims for enhanced compensation remain open. By mandating a timeline of eight weeks, the Court has effectively set a deadline for administrative compliance.
Crucially, the phrase "without prejudice to the rights and contentions" serves as a legal safeguard, ensuring that accepting the Commission's recommended amount does not bar the petitioners from pursuing further action to claim higher compensation in the future. This order balances the need for immediate humanitarian assistance with the legal prerogative of the claimants to seek full redressal for their grievances.
As it stands, the implementation of this order will be a significant test of the administrative efficiency of the GNCTD, providing much-needed closure to a chapter of systemic delay for the victims of the 2020 riots.
