In a move highlighting the judiciary’s role as the guardian of fundamental rights, the Delhi High Court has issued a directive to the Ministry of External Affairs (MEA) and the Consulate General of India in Dubai. The court ordered immediate action to verify claims of a 25-year-old Indian nurse being held against her will in the United Arab Emirates.
Presided over by Hon’ble Mr. Justice Sachin Datta , the court took urgent cognizance of the matter, emphasizing that the gravity of the situation warranted prompt government involvement to ensure the safety and repatriation of the Indian citizen.
The case originated from a petition filed by the father of the 25-year-old nurse. According to the plea, the ordeal began in 2023 when his daughter, then working at a hospital in Chennai, encountered a foreign national receiving medical treatment. The individual offered her a year-long contract to provide private nursing assistance in Dubai, UAE.
Trusting the offer and the professional prospect, the daughter traveled to Dubai on January 23, 2023. However, the situation deteriorated rapidly. After a brief period, communications became infrequent. The petitioner alleged that the foreign national eventually seized her passport and visa to prevent her from returning to India.
The situation spiraled into a humanitarian crisis in October 2025, when the daughter managed to contact her father, describing a harrowing experience involving physical abuse and deprivation of basic necessities. Photographs purportedly showing evidence of physical abuse were submitted to the court, providing a grim backdrop to the legal proceedings.
Faced with the failure of his initial representation to the Ministry of External Affairs, the petitioner sought the intervention of the Delhi High Court. Justice Datta, noting the urgency and the potential threat to the citizen's life and liberty, issued specific directions to the state machinery.
The judgment underscores the court’s commitment to citizen protection beyond borders: * "Given the gravity of the situation, the Ministry of External Affairs, Government of India and the Consulate General of India in Dubai, UAE are directed to take immediate steps to ensure the safety and well-being of the petitioner’s daughter." * "[The authorities are directed to] verify the allegations made in the present petition." * "Assistance be rendered to the petitioner’s daughter for her return to India, if she so desires."
The court’s order serves as a critical precedent for families seeking governmental aid to rescue loved ones trapped abroad under abusive circumstances. By setting a timeline of two weeks for the Ministry to file a status report, the Court has ensured that this matter will be monitored closely.
The case is now listed for further hearing on December 15, 2025 . While the legal process in a foreign jurisdiction is complex, this order compels the Indian Foreign Ministry to utilize diplomatic channels to secure the safety of the citizen, demonstrating the long reach of the Indian judiciary when it comes to the safety and welfare of its nationals.
