Repatriation of Indian Citizens Abroad
Subject : Constitutional Law - Writ Jurisdiction
In a significant order aimed at protecting citizens beyond national borders, the High Court of Delhi has stepped in to address the plight of a 25-year-old Indian woman allegedly held against her will in Dubai, United Arab Emirates. Justice Sachin Datta, presiding over the matter, has directed the Ministry of External Affairs (MEA) and the Consulate General of India in Dubai to take immediate action to ensure the safety and verification of the victim’s situation.
The ordeal began in January 2023, when the petitioner’s daughter, a nurse by profession, was recruited by a foreign national she had met while he was undergoing medical treatment in Chennai. Tempted by a job offer that promised medical assistance services in Dubai for one year, the young woman traveled to the UAE. However, what was intended to be a professional endeavor quickly devolved into a nightmare.
According to the petition, her employer increasingly isolated her, cutting off communication with her family and seizing her passport and visa to prevent travel home. The situation reached a breaking point in October 2025, when the petitioner received a harrowing call from his daughter, detailing systemic physical abuse and the deprivation of basic necessities. Supporting these claims, the family presented photographic evidence received via WhatsApp, illustrating the severe physical harm being inflicted upon the victim.
After an unsuccessful attempt to seek relief through a representation filed with the MEA on November 15, 2025, the petitioner moved the Delhi High Court. The court, recognizing the urgency and the gravity of the allegations, exercised its jurisdiction to compel state action.
"The Ministry of External Affairs, Government of India and the Consulate General of India in Dubai, UAE are directed to take immediate steps to ensure the safety and well-being of the petitioner’s daughter and verify the allegations made in the present petition," the order stated. The court further emphasized that assistance must be rendered for the daughter’s return to India, provided she expresses a desire to return.
The judgment underscores the duty of the state to intervene when Indian nationals in foreign jurisdictions face life-threatening situations:
This directive serves as a crucial reminder of the role of the judiciary in facilitating consular protection. By setting a strict timeline, with a status report due from the respondents within two weeks, the court has effectively placed the Ministry on notice to prioritize the welfare of citizens caught in such exploitative arrangements abroad.
The matter is now slated for further inspection on December 15, 2025. This case highlights a critical path forward for families seeking government intervention in instances of international labor exploitation and potential illegal confinement.
