In a decisive move to protect the rights of Indian citizens abroad, the Delhi High Court has directed the Ministry of External Affairs (MEA) and the Consulate General of India in Dubai to take immediate measures to secure the safety and repatriation of a 25-year-old Indian nurse allegedly held in involuntary confinement in the United Arab Emirates.
The case, brought before Hon'ble Mr. Justice Sachin Datta, involves a harrowing account of systemic exploitation. The petitioner, the father of the victim, stated that his daughter had traveled to Dubai in January 2023 under an employment contract arranged by a foreign national whom she had previously treated in a Chennai hospital.
What was promised as a one-year role providing medical assistance devolved into a nightmare. According to the petition, the employer not only refused to honor the return timeline but also confiscated the victim’s passport and visa. The situation reached a breaking point in October 2025, when the young woman reached out to her family with reports of severe physical abuse and deprivation of basic necessities.
Distraught by the lack of progress following a formal representation to the Ministry of External Affairs on November 15, 2025, the petitioner approached the High Court. He argued that his daughter’s fundamental rights—namely her liberty and safety—were being grossly violated in a foreign jurisdiction, necessitating the immediate intervention of the Indian government to preserve the life of its citizen.
Recognizing the urgency of the plea, the Court did not delay. Justice Sachin Datta emphasized that given the gravity of the allegations—which included photographic evidence of physical injury—the state must be proactive in its consular role.
The Court has ordered the MEA and the Consulate General of India in Dubai to: * Immediately verify the allegations. * Ensure the physical safety and well-being of the petitioner's daughter. * Facilitate her return to India, provided that is her desire.
The court’s tone reflected the severity of the circumstances:
> "In the circumstances, given the gravity of the situation, the Ministry of External Affairs, Government of India and the Consulate General of India in Dubai, UAE are directed to take immediate steps to ensure the safety and well-being of the petitioner’s daughter and verify the allegations made in the present petition."
> "Further, assistance be rendered to the petitioner’s daughter for her return to India, if she so desires."
By requiring a status report within two weeks, the High Court has effectively turned the spotlight on the necessity for prompt consular action in cases of domestic and professional exploitation abroad. The matter is set for further hearing on December 15, 2025.
For the Indian diaspora and workers abroad, this order serves as a reminder of the state’s obligation to provide diplomatic protection and intervention when the safety of its citizens is compromised on foreign soil. The reliance of the Court on the prompt provision of contact details provided by the petitioner highlights the utility of early institutional engagement when facing international crises.
