A Quest for Justice: Delhi High Court Steps In to Trace Two-Decade-Old Compensation

In a matter highlighting the complexities of administrative record-keeping in the wake of judicial district reorganizations, the High Court of Delhi has intervened to ensure that a land acquisition claimant finally receives her dues. The case of Smt Jaypali v. Union of India & Ors. centers on a compensation award dating back to 2008 that had seemingly vanished into the bureaucratic ether.

The Background of the Claim

The petitioner, Smt Jaypali, had been declared entitled to compensation for acquired land following an adjudication by the Additional District Judge (LAC) on March 12, 2008. However, in the nearly two decades that followed, the compensation—specifically noted as Rs. 269—remained undistributed.

The primary hurdle, according to the Court, appeared to be the administrative reorganization of the judicial districts. It was inferred that the reorganization of the Karkardooma Courts likely caused a breakdown in the transmission of case records and the associated compensation funds.

Arguments and Judicial Scrutiny

During the proceedings, Mr. Sanjay Kumar Pathak, counsel for the Union of India, acknowledged the legitimacy of the 2008 award. The Court, presided over by Justice Nitin Wasudeo Sambre and Justice Anish Dayal, expressed a clear expectation that the state must facilitate the payout of funds once an entitlement is established.

The central legal question was administrative: How should a Court rectify the "disappearance" of funds and records caused by systemic administrative changes? The bench resolved that the onus lies with the current judicial administration to track down the historical deposit and finalize the distribution.

The High Court emphasized the necessity of accountability in judicial administration:

  • On the transfer of records: "We presume that since the land was acquired from the judicial district of Karkardooma Courts, the compensation must have been transferred along with the transfer of judicial proceedings to the Karkardooma Courts."
  • On the duty to disburse: "We also make it clear that, in case, if the amount which is to the tune of Rs.269/- is traced, the same be disbursed in favour of the petitioner upon verifying her identity with all the accrued interest thereon."
  • On administrative oversight: "Learned Principal District & Sessions Judge, Shahdara shall take up the present proceedings on the administrative side and find out as regards the deposit of the amount, as has been reflected in para no.1 of the Award dated 12th March 2008."

The Court’s Decision: A Path Forward

The Delhi High Court has issued a time-bound mandate to resolve the issue:

  1. Administrative Inquiry: The Registrar (Judicial) must transmit all records to the Principal District & Sessions Judge, Shahdara, within three days.
  2. Compliance Report: The Principal District & Sessions Judge has been given eight weeks to locate the relevant records and the deposited compensation.
  3. Flexibility: The Court granted liberty to the Principal District & Sessions Judge to involve colleagues from the East or North-East Districts if the records are traced there.
  4. Final Disbursement: Upon location of the records and identity verification, the petitioner is entitled to receive the principal amount of Rs. 269 alongside all accrued interest.

This order serves as a reminder of the court's protective jurisdiction, ensuring that even minor, long-standing financial claims of ordinary citizens are not lost to administrative transitions. The matter is currently listed for compliance on March 16, 2026.
