In a poignant display of judicial empathy, the High Court of Delhi has intervened to ensure that the educational journey of a Class X student remains uninterrupted, despite severe financial constraints facing his family. The order, passed by the bench of Hon'ble Mr. Justice Vikas Mahajan, underscores the court's role in protecting the academic rights of students when personal tragedies threaten their future.
The petitioner, Master Arnav Raj, a student of Delhi Public School (Respondent No. 1), faced the prospect of expulsion after his father, following a serious accident and subsequent loss of employment, found himself unable to maintain the school’s fee payment schedule.
Initially, in May 2025, the court had permitted a payment plan involving monthly installments. While the family initially complied, the compounding pressures of an ailing grandfather’s medical expenses and the loss of the primary breadwinner’s job led to a default in payments. Consequently, the school invoked its authority under the Delhi School Education Rules, 1973, and struck the student's name from its rolls in September 2025.
The matter took an extraordinary turn during the hearing when Mr. R. K. Kapoor, an advocate not originally representing the petitioner but present in the courtroom for unrelated proceedings, witnessed the distressing situation of the student’s father. Moved by the family's plight, Mr. Kapoor volunteered to contribute Rs 2,50,000 towards the outstanding dues, bridging a critical gap that had led to the child’s removal from school.
The High Court balanced the school's right to collect fees against the overarching necessity of protecting the student’s right to continue his education in his final year of secondary study. While acknowledging that schools operate on financial sustainability, the court adopted a flexible approach, considering the "peculiar facts and circumstances" of this case.
The court's decision was centered on finding a constructive solution rather than a purely adversarial one. By facilitating a "full and final settlement" through the advocate's generous contribution, the court effectively removed the barrier to the student's return, while ensuring the school received a substantial portion of the outstanding fees.

While the court explicitly noted that this specific order acts as a "one-off" relief due to the extraordinary circumstances and should not be used as a binding legal precedent, it sets a powerful moral example. By prioritizing the educational welfare of the student, the court has provided a lifeline to a family in distress, ensuring that financial misfortune does not derail a young student's path to his Board examinations.
