In a significant ruling regarding the limits of judicial reach, the High Court of Delhi has clarified that a party cannot invoke the jurisdiction of a non-local High Court simply because the original administrative authority is situated in that region. The Bench, comprising Chief Justice Devendra Kumar Upadhyaya and Justice Tejas Karia, dismissed cross-appeals filed by Vedanta Limited and the Nominated Authority, reaffirming that the location of the adjudicating tribunal is central to determining territorial jurisdiction.

The Backdrop: A Mine and a Mandate

The dispute stems from a 2020 tender for the Radhikapur (West) Coal Mine. Vedanta Ltd emerged as the successful bidder, entering into a Coal Mine Development and Production Agreement (CMDPA) in 2021. However, the project subsequently faced delays in achieving critical milestones, leading to show-cause notices and the eventual appropriation of funds from a Performance Bank Guarantee (PBG).

Vedanta sought refuge in various legal forums, ultimately initiating proceedings before the Special Tribunal in Talcher, Odisha. When the Tribunal declined ex parte interim relief, the company turned to the Delhi High Court. The central conflict: Was the Delhi High Court the appropriate forum to challenge orders passed by a Tribunal seated in Odisha?
