Writ Jurisdiction
Subject : Civil Law - Sports Law
The High Court of Delhi, led by Hon'ble Ms. Justice Mini Pushkarna, has moved to postpone arguments in a series of writ petitions filed by various district-level swimming associations against the Swimming Federation of India. The proceedings, which involve seven specific district bodies, reflect ongoing administrative tensions within the sport’s governing framework.
The petitions, brought forward by associations including the New Delhi District Swimming Association, the West District Delhi Swimming Association, and several others representing North West, South West, North East, South East, and South Delhi, challenge the actions or processes of the Swimming Federation of India.
The courtroom saw active participation from the petitioners’ legal team, led by Mr. Rahul Kumar, Mr. Vishesh Kumar, and Ms. Prity Kumari. Representing the respondents were Ms. Manini Brar for the Returning Officer and Ms. Sunita Singh and Mr. Abhigya Kushwah for the Swimming Federation of India.
The court, acknowledging the arguments presented by the petitioners, determined that more time is required to adequately address the complexity of the matters raised in the various petitions. Consequently, the court has directed the matter to be re-notified for further arguments.
The proceedings on December 3, 2025, were primarily focused on the preliminary stage of arguments. The court's order reflects its adherence to judicial due process before reaching a decision:
> "Arguments have been advanced by learned counsel appearing for the petitioners. For further arguments, re-notify on 05th December, 2025."
As the case stands adjourned until December 5, 2025, the swimming community remains in a state of watchfulness. The outcome of these petitions may set a precedent for how district-level swimming associations engage with the national governing body, particularly regarding regulatory compliance and administrative oversight.
For now, all parties are expected to reconvene at the High Court on the designated date to continue arguments. Legal experts will be closely watching whether these petitions yield specific directions for the Swimming Federation of India or if further investigation into the grievances of the district associations will be ordered by the court.
