Delhi High Court Affirms Acquittal in 32-Year-Old Case, Citing Lack of Evidence

New Delhi, India – The Delhi High Court has upheld the acquittal of an accused in a case dating back to 1991, emphasizing the prosecution's failure to substantiate the charges after more than three decades. Justice AnishDayal presided over the revision petition filed by the State (Govt. of NCT of Delhi) against the respondent, Jagmohan Singh @ Jaggar Singh .

Case Background

The case originated from FIR No. 155/1991, registered at Defence Colony Police Station, following a complaint by Mr. Ashok Kumar . The charges were filed under Sections 323 (voluntarily causing hurt), 341 (wrongful restraint), and 506 (criminal intimidation) of the Indian Penal Code (IPC). The Metropolitan Magistrate (MM) court had initially acquitted the respondent, a decision that was further affirmed by the Additional Sessions Judge (ASJ) in a dismissed appeal by the State.

Court's Reasoning

Justice Dayal , in his judgment, underscored the concurrent findings of the lower courts. Both the MM and ASJ had concluded that the prosecution had not presented sufficient evidence to prove its case. The High Court noted the extensive passage of time since the FIR was lodged in 1991 and the incident itself, stating, "Almost 32 years have passed since then."

The court observed that both lower courts "appreciated the evidence on record and have come to a finding of fact that the prosecution has failed to prove its case beyond reasonable doubt." Finding no "perversity or illegality" in the orders of the lower courts, Justice Dayal dismissed the State's revision petition.

> "Having perused the impugned order as well as the trial court order, this court is of the view that both the courts below have concurrently found that the prosecution has failed to prove its case. It is pertinent to note that the FIR is of the year 1991 and the incident is also stated to be of the same date. Almost 32 years have passed since then." - Justice AnishDayal , Delhi High Court

Implications of the Judgment

This decision highlights the critical importance of timely prosecution and the challenges faced by the justice system when cases linger for decades. While the specifics of the evidence are not detailed in this order, the judgment underscores the principle that the burden of proof rests with the prosecution, and failure to meet this burden, even in cases registered long ago, will result in acquittal. The case also serves as a stark reminder of the delays within the Indian judicial system, where cases can remain unresolved for over three decades.

Final Outcome

The Delhi High Court dismissed the revision petition, thereby upholding the acquittal of Jagmohan Singh @ Jaggar Singh . The related application, CRL.M.A. 2023/2023, was also dismissed as infructuous.
