O R D E R
Petition for Special Leave to Appeal (C) No. 12491/2018
1. Mr. Siddharth Dave, learned Senior counsel appearing for the petitioners states that a draft for a sum of ₹9,32,099/- (Rupees Nine lakhs thirty two thousand ninety nine only) has been drawn in favour of the respondent No.1 for being handed over to the other side.
2. Learned counsel for the respondents draws the attention of this Court to the documents marked as Annexure A-4 enclosed with the additional affidavit filed by the petitioners, in particular, page 42 to submit that even as per them, the respondent No.1 is entitled to receive a sum of ₹12,80,345/- (Rupees Twelve lakhs eighty thousand three hundred forty five only), in terms of the impugned order.
3. The balance amount with updated interest shall be paid by the petitioners to the respondent No.1 within two weeks from today. In the meantime, the respondent No.1 is at liberty to encash the draft handed over by the other side, without prejudice to his rights.
4. Coming to the order passed by this Court on 10th October, 2023, Mr. Dave states that an affidavit has been filed furnishing inter alia, the details of the three Directors of the Company dealing with the present project.
5. On enquiring as to how many other litigations are pending in respect of the said project, we are informed that there are 347 flat allottees who have filed proceedings against the Company before different fora in the State of Rajasthan and before the NCDRC.
6. Learned counsel for the respondents submits that the Group Companies in the instant case are 123 in number, as per the public document that was issued by Sahara Prime City Limited in the year 2009. 7. The petitioners are directed to furnish the details of the top 50 Companies forming a part of the Sahara India Pariwar with the details of the top 20 Directors of each of the said 50 Companies. To start with, the details of the assets of 10 of the Group Companies and their top 20 Directors shall be furnished within three weeks.
8. List on 06th February, 2024, for further orders.
Petition for Special Leave to Appeal (C) No. 17440/2018
1. It is submitted by learned Senior Advocate appearing for the petitioners that in terms of para 3 of the Memorandum of Settlement dated 06th November, 2023 whereby the parties have arrived at a settlement, the petitioners have paid all the amounts due and payable to the respondents and he has instructions not press the present petition.
2. The Petition for Special Leave to Appeal is accordingly, disposed of as not pressed.
