The appeal was filed against an order passed by the High Court of Calcutta, which declined to grant relief to the appellant regarding a claim for compassionate appointment. The appellant's father, who was an employee of the West Bengal State Electricity Distribution Company Limited (WBSEDCL), had passed away in 2012, and the appellant applied for compassionate appointment in 2015.
The appellant argued that he had suffered an accident and was currently 70% disabled, and that the authorities should reconsider his application for compassionate appointment. The respondent, WBSEDCL, submitted that the appellant did not meet the physical eligibility criteria for employment and that the appellant had filed a subsequent writ petition after the dismissal of the first one, suppressing the material fact of the earlier filing.
The court noted that compassionate appointment is intended to provide immediate financial assistance to the family of a deceased employee, and the appellant's application was made after a delay of 2.5 years from the date of the father's death. The court found that this delay suggested the family was not in immediate financial distress.
The court also observed that the appellant's physical disability did not mean the criteria laid down for appointment of an employee should be diluted. The court stated that requiring the respondent, an electricity distribution company, to lower its physical parameters for employment could adversely affect the entire recruitment process and be inimical to public interest.
The court dismissed the appeal, finding no ground to interfere with the order of the learned Single Judge. The court held that the appellant's delayed application and failure to meet the physical eligibility criteria justified the rejection of his claim for compassionate appointment.
