Disciplinary Proceedings Against Employee Abate on Death: Rajasthan High Court

In a significant judicial order reinforcing the principles of natural justice, the Rajasthan High Court has clarified that disciplinary proceedings initiated against an employee must necessarily come to an end upon their death. The court observed that the impossibility of providing an effective defense post-mortem renders further inquiry legally unsustainable.

Case Background

The petition was filed by Girdhari Karmachandani, who had challenged a charge-sheet dated June 9, 2015, and an amended charge-sheet dated August 4, 2015, issued by the Punjab National Bank. As the dispute made its way through the judicial process, the petitioner passed away. The matter was then contested by his legal representatives, represented by his wife, Arti Karmachandani, and another lawful heir.

The core legal question before the court was whether the bank could legally continue with a departmental inquiry against an employee who is no longer alive to contest the allegations.

Arguments and Judicial Reasoning

The court’s reasoning centered on the fundamental requirement of an "opportunity to defend." Justice Anoop Kumar Dhand remarked that disciplinary proceedings are inherently personal to the delinquent employee.

As the court noted, the burden of truth in a departmental enquiry relies heavily on the delinquent’s personal knowledge of the facts. Once the employee passes away, any opportunity to cross-examine, explain, or effectively defend the allegations is lost. Consequently, the High Court determined that continuing the proceedings in the absence of the accused would be a violation of the underlying spirit of departmental fairness.

The judgment offers clear guidance on the cessation of such proceedings after the demise of an employee:

> "Once allegations are made against an employee who is no longer alive, there is no one who can effectively defend those allegations on his behalf."

> "Unless the employee is given a proper opportunity to defend himself, no proceedings can continue to establish the allegations levelled against him."

> "Since the delinquent employee... has expired, the respondents cannot proceed against him on the basis of the charge-sheets... and the proceedings arising out of these charge-sheets come to an end automatically."

The Court's Decision

The Rajasthan High Court ordered the immediate abatement of the disciplinary proceedings initiated by Punjab National Bank. The court further directed the bank to release the terminal dues of the deceased petitioner in favor of his legal representatives.

The respondents have been instructed to process any representation submitted by the legal heirs with a reasoned and speaking order, ensuring that the matter is handled expeditiously. This ruling serves as a vital precedent, emphasizing that administrative departments cannot pursue disciplinary action against deceased individuals, thereby protecting the rights of legal heirs to a fair final settlement of dues.
