O R D E R
The Deed of Settlement/MOU dated 2nd February, 2024 is taken on record.
We are happy to note that the parties have arrived at an amicable settlement. Both, the petitioner and the respondent, are personally present in the Court. Both of them agree that they have signed the aforesaid Deed of Settlement/MOU. Today, in the Court, for a sum of Rs.25 lakhs bearing DD No.518357 dated 31st January, 2024 issued by the ICICI Bank Limited drawn in favour of Divya Agarwal, the petitioner.
The learned counsel appearing for the respondent, on the instructions of the respondent, who is personally present in the Court, states that the balance amount of Rs.1 crore shall be paid on or before 15th April, 2024. The learned counsel appearing for the respondent, on instructions, further states that as agreed in paragraph 5 of the Deed of Settlement/MOU, the respondent will get a demand draft for a sum of Rs.1 crore issued in the name of the petitioner and he will deposit the same with the Registry of this Court on or before 15th April, 2024. The learned counsel appearing for the respondent will give an intimation of the deposit of the demand draft of Rs.1 crore with the Registry of this Court to the learned counsel appearing for the petitioner along with a true photocopy of the demand draft. Immediately, on receiving the said intimation, the petitioner will execute a deed of relinquishment as provided in clauses 6 and 7 of the Deed of Settlement/MOU.
The parties have agreed to put an end to the following proceedings:
1. Domestic Violence Case No.2195 of 2022 pending before the learned Additional Chief Judicial Magistrate-IV, Lucknow, Uttar Pradesh;
Additional Principal Judge, Family Court-II, Lucknow, Uttar Pradesh;
Additional Principal Judge, Family Court-VII, Lucknow, Uttar Pradesh;
4. Case No. 3172 of 2022 pending before the learned Principal Judge, Family Court, West Tis Hazari Courts, Delhi;
5. Case No. GW/5/2023 pending before the learned Additional Principal Judge, Family Court, Gurugram, Haryana.
6. CS/86/2022 pending before the Family Court, Lucknow, Uttar Pradesh; and 7. CS/107/2022 pending before the Court of the learned Principal Judge, Family Court, Lucknow, Uttar Pradesh.
In view of the settlement, none of the above proceedings will proceed further and the same shall remain stayed, till further orders.
List on 19th April, 2024.
