2003 Supreme(SC) 185

S.B.SINHA, A.R.LAKSHMANAN
Abati Bezbaruah – Appellant
Versus
Dy. Director General Geological Survey Of India – Respondent

Judgement Key Points

Certainly. Based on the provided legal document, here are the key points:

  • The determination of the rate of interest in a motor accident claim depends on the facts and circumstances of each case, including factors such as inflation, economic changes, prevailing bank rates, duration of the case, and the nature of injuries suffered (!) (!) .

  • Interest is awarded as compensation for the delay or detention of money that is rightfully payable to the claimant. It is a consequential measure and not fixed by law under specific statutory provisions, leading to varying rates of interest awarded by courts and tribunals depending on case-specific factors (!) (!) .

  • The rate of interest should be just and reasonable, typically aligning with the bank rate at the relevant time, but no fixed percentage is mandated under the relevant statutory provisions. Courts have discretion to award interest at different rates, considering the circumstances of each case (!) (!) .

  • In cases involving compensation under the Motor Vehicles Act, the structured formula provided in the Second Schedule generally guides the calculation of compensation. Deviations from this formula are permissible only in exceptional circumstances, and the amount awarded must be just and fair based on the facts of the case (!) (!) .

  • When assessing compensation for loss of dependency, the calculation should consider the deceased's age, income, future prospects, and applicable multiplier. An appropriate multiplier (e.g., 15) is applied to the annual dependency amount, which is derived after reasonable deductions for personal expenses (!) .

  • The amount of future dependency should be calculated based on a realistic estimate of the deceased's future income, considering potential career progression and inflation, rather than a fixed or conservative figure (!) .

  • The courts emphasize that there is no rigid rule for awarding interest rates; instead, discretion is exercised based on the specific circumstances, including economic factors and the duration of the case (!) .

  • The overall goal is to ensure that the awarded compensation and interest are fair, just, and proportionate to the case's facts, with courts reserving the discretion to adjust rates accordingly (!) (!) .
