State of Gujarat (2002) 2 SCC 513 and Sajan Abraham v. State of Kerala (2001) 6 SCC 692 - Appeals referred to larger Bench. [Para 2]

( 1 ) LEAVE granted.

( 2 ) HAVING regard to the conflict in the decisions of this Court in Abdul Rashid Ibrahim Mansuri v. State of Gujarat and Sajan Abraham v. State of Kerala both rendered by a three-Judge Bench, relating to the provisions of Section 42 of the NDPS Act, these appeals are referred to a larger Bench.

( 3 ) TAG with Crl. Appeal No. 36 of 2003.

( 4 ) PAPERS be placed before the Honble the Chief Justice of India for appropriate orders.
