( 1 ) THE judgment of the First Additional Metropolitan sessions Judge, Hyderabad, in S. C. No. 458/ 1993 dated 1-3-1995 convicting both the appellants (accused No. l and 2 in the trial court) under Sections 498-A and 302 read with Section 34 of Indian Penal Code and sentencing them to undergo rigorous imprisonment for a period of two years besides fine of Rs. 100/- each in default to suffer simple imprisonment for one month and imprisonment for life and to pay a fine of rs. 200/- each in default to suffer simple imprisonment for a period of one month is under challenge in this appeal. They will be referred to as accused No. 1 and 2 in the course of this judgment.
( 2 ) THE prosecution case in brief is that the accused persons are residents of hyderabad and the material prosecution witnesses are residents of Khaslabad, Medak district. The deceased Aruna was the wife of accused No. 1 and she will be referred to as the deceased . Accused No. 2 is the mother of accused No. 1 while accused No. 3 and 4 who are acquitted are brother and sister of accused No. 1 respectively.
