( 1 ) THE Petitioner seeks Writ of mandamus declaring that the B. P. M. S. No. 309, dated 29-9-1991 has no application or, in the alternative, the said order, coupled with the orderdated 21 -11-1991, are illegal and arbitrary and for consequential direction.

( 2 ) AN important issue that arises for consideration in this Writ Petition is whether there could be a lien on the post when the department itself is closed and the post held by the employee was transferred to some other Department with the employee consequent on the closure of the Department under the same management.

( 3 ) FEW facts relevant for proper appreciation of the case are that the petitioner was originally appointed as Typist in february, 1968, in the service of the a. P. State Electricity Board. His Unit of appointment was Ramagundam Thermal station (R. T. S. ). He was promoted on 1 -7-1978 as U. D. C. However, the said unit was closed in the year 1984 and 21 members of office staff, including the petitioner, became surplus and they were diverted to variousother establishments underthe Board.
