( 1 ) THE person-in-charge of buja Buja Nellore Gram Panchayat along with the other residents of the said Gram panchayat approached this Court seeking declaration that the action of the Respondents no. 1 to 4 converting the Uramgunta tank situated in Survey No. 36 of Buja buja Nellore Gram Panchayat, Nellore rural Mandal, Nellore District into house plots for the purpose of assignment to third parties is illegal and contrary to the provisions of A. P. Panchayat Raj Act, 1994.
( 2 ) THE facts leading to the case are that the 1st petitioner is the person-in-charge of Buja Buja Nellore Gram Panchayat, 2nd petitioner is the Upa-sarpanch of the village and other petitioners are residents. There is Uramgunta cheruvu in buja Buja Nellore Gram Panchayat over an extent of 15 acres of land in S. No. 36. The tank has been in existence since times immemorial. The tank was being used by the villagers for various community purposes such as washing purpose, drinking water by the cattle.
