( 1 ) THE Petitioner, who is running a canteen in the premises by the Tiru- mala-Tirupati Devasthanams. (TTD for short) seeks a writ of mandamus declaring the proceedings of the Commissioner of Endowments, Andhra pradesh, the first respondent herein, passed in O. A. No. 2 of 1988, as without jurisdiction and illegal, and consequently violative of Article 19 (1) (g) of the Constitution of India, besides being contrary to the principles of natural justice.

( 2 ) THE relevant format of the case in brief is, the petitioner is running a. N. C. Canteen , in a building let out by TTD on the Tirumala hills since the year 1982 on payment of Rs. 1,500/- as rent per month. While so, the Board of Trustees of TTD, the second respondent herein, passed a resolution No. 856 dated 3-3-87 resolving to demolish the building in which the canteen was being run by the petitioner. Thereupon, the petitioner filed a suit in OS. No. 320/87 in the Court of the Subordinate Judge, tirupati, for a permanent injunction and pending the same, ad-interim injunction was granted, only to be modified later to maintain status quo, with an observation that it would be open to the second respondent to take any steps op
