( 1 ) THIS is a revision petition under sec. 91 of the Andhra Pradesh (Telangana area) Tenancy and Agricultural Lands act 1950 (hereinafter referred to as the act ) filed by the landholder. Before the Revenue Divisional Officer, Adllabad, the landholder sought resumption of the land under Sec. 44 of the Act. That application was dismissed on the ground that under Sec. 44 (5) (a) of the Act the right of termination of the tenancy of any protected tenant under sub-Sections (I), (2) and (3) shall cease after five years from the date of the commencement of the Hyderabad Tenancy and Agricultural lands (Amendment) Act, 1954. As tht application was made on 11-7-1963 the revenue Divisional Officer held that It was beyond five years from the date of the commencement of the amendment act of 1954, which is 4th February, 1954 and hence the application for resumption should be rejected. On appeal, the District revenue Officer had confirmed the order of the Revenue Divisional Officer and dismissed the appeal
