1. This civil revision petition, under Article 227 of the Constitution of India, calls in question the order dated 02.07.2012 passed by the Court of the Judge, Family Court – cum – VII Additional District and Sessions Judge, Medak, at Sangareddy, dismissing I.A. No. 26 of 2012 in O.S. No. 120 of 2011 filed by the third parties/petitioners herein under Order I Rule 10 of the Code of Civil Procedure.
2. The facts and circumstances leading to the filing of the present revision are as under:-
3. The 1st respondent herein instituted the suit, being O.S. No. 120 of 2011, against the respondents 2 to 4 herein seeking the following reliefs:-
(a) Decree be passed directing the defendants to receive the balance sale consideration of Rs. 1,50,000/- and execute and register sale deed in favour of the plaintiff or his nominees for A, B and C schedule properties.
(b) That in the event of the failure of the defendants to receive the balance sale consideration, the plaintiff may be permitted to deposit the same in this Hon’ble Court and this Hon’ble Court may be pleased to appoint a commissioner to execute the sale deed as prayed for.
