This Company Petition is filed under Section 439(1)(b) and 433(e) r/w. Section 434(1)(a) of the Companies Act, 1956 (for short "the Act") for an order to wind up the respondent for nonpayment of the alleged debt due to the petitioner.
The averments, based on which the Company Petition is filed, briefly stated, are as under:
That the petitioner which formed into a joint venture vide agreement dated 28-7-2008, nominated M/s. The Indian Hume Pipe Company Limited (IHPCL), as its lawful attorney on behalf of the joint venture to perform all acts and deeds as mentioned in the General Power of Attorney (GPA). That the IHPCL, partner in-charge of the petitioner, is a leading construction company engaged in the business of manufacturing, laying, jointing, testing, commissioning etc., of BWSC, MS, PCCP & PSC and other types of pipes in execution of water supply schemes in various states including the State of Andhra Pradesh.
