Headnote:Section 13 (1) (ia)-Petition for divorce by husband on ground of cruelty_ Evidence-Husband harassed and ill treated his wife physically and mentally Wife was turned out of matrimonial borne-Petition for divorce dismissed Appeal-Divorce petition allowed-Appeal by wife-Incidents as alleged cannot be cruel treatment by wife-It was rather cruelty on part of husband-Held, husband cannot be allowed to take advantage of his own wrongs.

       In view of the discussion, it is more convincing that Ramesh assaulted Rajni on the pretext of not preparing a tea as per his desire. She therefore, made escape and took shelter at the place of Choudhary. Ramesh is trying to give colour of irresponsible attitude of Rajni.

       In view of the discussion in the foregoing paras Court has reached the conclusion that Ramesh is making an attempt for the purposes of seeking a divorce by taking advantage of his own wrong and ill doing.
