Rajeev Ranjan Prasad, J.—The sole appellant in this case is seeking setting aside of the judgment of conviction dated 19.12.2015 and the order of sentence dated 02.01.2016 passed by learned Additional Sessions Judge – I, Gopalganj in Sessions Trial No. 370/2007/Registration No. 1974/2013 arising out of Vijaipur P.S. Case No. 74 of 1994 dated 21.09.1994 registered for the offence under Sections 302/34, 201 and 379/34 of the Indian Penal Code (‘I.P.C.’) read with Section 27 of the Arms Act.

By the impugned judgment and order the appellant has been convicted for the charges under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act and has been ordered to undergo life imprisonment and to pay a sum of Rs. 10,000/- as fine. On failure to deposit the fine the appellant shall be liable to undergo an additional period of six months. For the offence under Section 27 of the Arms Act he has been sentenced to undergo three years of imprisonment and a sum of Rs. 5,000/- as fine, in case of failure to deposit the fine he would be required to undergo imprisonment for an additional period of three months. Both the sentences are to run concurrently.
