2. This appeal has been filed against the judgment of conviction dated 25.02.2017 and order of sentence dated 02.03.2017 passed by the learned 1st Additional Sessions Judge, Saran at Chapra in connection with N.D.P.S. Case No. 11 of 2014 (CIS Registration No. 101 of 2014) arising out of Sonepur P.S. Case No. 169 of 2014, whereby and whereunder the appellants have been convicted for the offences punishable under Sections 20(b) (ii) (c) and 22 (c) of the N.D.P.S. Act and sentenced to undergo rigorous imprisonment for 10 years and to pay a fine of Rs. 1,00,000/- each (Rupees One Lakh only) for the said offences, in default of payment of fine, to further undergo simple imprisonment for a period of 3 years and both the sentences have been directed to run concurrently.
3. The appellants and co-accused persons, namely, Rakesh Singh and Chandan Singh were tried together and were jointly charged for the offences punishable under Sections 20(b) (ii)(c) and 22(c) of Narcotic Drugs and Psychotropic Substances Act (hereinafter referred to as “NDPS Act”) and the appellants were also charged for the offence punishable under Section 414 of the IPC.
