1. The appeal is directed against the judgment and order dated 29.6.1994 and 30.6.1994 passed by learned Additional Sessions Judge, 1st Fast Court, Alipore, South 24 Parganas, in Sessions Trial No. 3(6) of 1993 corresponding to Sessions Case No. 79(4) of 1993 convicting the appellants herein for the commission of offence punishable under sections 302/149/148/448/149 of the Indian Penal Code and sentencing them to suffer rigorous imprisonment for life and to pay a fine of Rs. 300/- in default to further rigorous imprisonment for one year more for the offence under sections 302/149 of Indian Penal Code, rigorous imprisonment for two years for the offence punishable under section 148 of Indian Penal Code and rigorous imprisonment for one year for the offence under sections 448/149 of Indian Penal Code, all the sentences to run concurrently. Prosecution case, as alleged, against the appellants is to the effect that on 2.4.1987 at about 12.00-12.30 p.m. the victim Joya Sardar along with his wife Sumitra @ Chali Sardar (P.W. 1) was in their house.
