JUDGMENT
Sanjay K. Agrawal, J. - Proceedings of this matter have been taken-up for hearing on the question of admission through video conferencing.
2. Heard on I.A.No.1/2020, the application for condonation of delay in filing the application for leave to appeal.
3. Sufficient cause has been shown for delay in filing this petition. Accordingly, the application for condonation of delay is allowed and delay is condoned.
4. Also heard on admission.
5. Mr. Vikram Sharma, learned State counsel appearing for the petitioner, would submit that the learned Judicial Magistrate First Class is absolutely unjustified in acquitting the respondents of the offence under Section 188 of the IPC on the ground that despite sufficient opportunity, no witnesses were examined to support the case of the prosecution as no reasonable opportunity was granted to adduce evidence.
6. I have considered the submissions put-forth on behalf of the State / petitioner and went through the record with utmost circumspection.
7. Charge-Sheet was filed by the Station House Officer, Police Station Civil Lines, Raipur before the jurisdictional criminal court for commission of the alleged offence under Section 188 of the IPC
