1. The Petitioner has filed the present Writ Petition under Article 226 of the Constitution of India primarily praying for writ of mandamus to direct the termination of the contract between the Government of India, Ministry of Commerce & Industry acting through the Directorate General of Supplies & Disposals (DGS&D) and Respondent No.4 C-1 India Pvt. Ltd. whereunder Respondent No.4 is providing services for the conduct of e-tendering/e-procurement process to Respondent No.2. The petitioner also seeks to challenge the extension and amendment thereof, which has the effect of widening the scope of the contract to offering the e-tendering solution/software of respondent no.4 to other State Government Agencies/Public Sector Undertakings etc. by using the good offices of DGS&D.
2. The Petitioner is a company incorporated under the Companies Act having its registered office at Mumbai. The Petitioner claims to be in the business of providing application software solutions and services, particularly electronic procurement software solution and services to the Government and semi Government agencies.
