JUDGMENT :

RAJIV SAHAI ENDLAW, J.

1. The petitioner workman by this petition impugns the order dated 17th January, 1998 of the Industrial Tribunal in a proceeding commencing with the following reference made by the Delhi Administration: “Whether the termination of services of Sh. Mahipal Singh is illegal and / or unjustified, if so, to what relief is he entitled and what directions are necessary in this respect?

2. It was the case of the petitioner workman resident of District Meerut, Uttar Pradesh, that he was appointed as Work Mistry on 13th March, 1984 in the National Seeds Corporation Ltd. (NSCL), having its head office at Beej Bhawan, Pusa Complex, New Delhi, by its Joint Manager Sh. K.C. Aggarwal at Delhi; however no appointment letter was issued to him and he was sent for work first to Bareilly and then to Bhopal and whereafter his services had been terminated. The respondent NSCL while contesting the claim of the petitioner workman also contended that the Delhi Administration which had referred the dispute to the Industrial Tribunal had no power or right to refer the same and hence the terms of reference were without jurisdiction and bad in law.
