1. Late Harcharan Singh Brar, who died on 6th September, 2009, had two wives, namely Mrs. Jagir Kaur, who died in 1992 and Mrs. Gurbrinder Brar (defendant No.2). The plaintiff Adesh Kanwarjit Singh Brar is the son of late Shri Harcharan Singh Brar from his second wife Mrs. Gurbrinder Brar, whereas defendant No.1 Ms. Babli Brar is his sister. Defendant No.3 Ms. Charanjit Kuar Brar is the step sister of the plaintiff being the daughter of late Shri Harcharan Singh Brar from his first wife Mrs. Jagir Kaur.
2. The case of the plaintiff is that late Shri Harcharan Singh Brar was karta of Brar HUF, which owned agricultural land measuring about 2000 acres in Village Serainaga, District Muktsar, Punjab. It is further alleged that on or about September 13, 1951, there was a partition of the ancestral agricultural property, which formed a part of the estate belonging to Brar HUF. Under the partition, agricultural land was divided between the plaintiff, defendant No.2 Mrs. Gurbrinder Brar, Mussammat Uttam Kaur, mother of late Shri Harcharan Singh Brar and late Shri Harcharan Singh Brar.
